Duplicate check applies when signing petition regardless of profile setting

Hi,

I found a discrepancy between the documented and actual behaviour for duplicate matching when signing a petition. Testing on a 4.3.8 / Drupal 6 site, signing a petition as anon but with email etc matching an existing contact, I found that duplicate checking is applied regardless of the "What to do upon duplicate match" setting in the contact profile: with this set to "Allow duplicate contact to be created", an existing contact was modified. So an anon user can modify an existing contact.

However the behaviour documented at http://book.civicrm.org/user/current/petition/setup/ is:

For both profiles, you may want to select the following settings in the Advanced Setting area:

    For Drupal user account registration option?, select the radio button for No account create option if you do not want all petition signers to have a Drupal account created.
    For What to do upon duplicate match, you can select the radio button for Allow Duplicate Contact to be Created if you don't want  anonymous users to update an existing contact record's information; you will then need to periodically dedupe records.

Which is correct?
