Event registration mailing opt in and out problem

Joomla 1.5.22
CiviCRM 3.2.3

We have a profile for even registraion that uses a mailing sign up option as part fo the profile settings, eg subscribe to our general newsletter when registering.

However when the same person [using same email] returns and books another event if they DONT click the checkbox for opt in they are unsubscribed from the list when they have already previosuly opted in.

How can we keep them subscribed to the mailing group on subsequent registrations ?

only way for the system to know if that field has data pertaining to that visitor is to get them to login afaik. maybe set the 'get our email' to default to ON?

How do you put that check box ? added the groups or a custom field ?

We put the check box by using the add to group option in registration settings.
