Unique email in membership application

I have memberships forms with pay by cheque payment option. They require an email address. This email address is also saved as the contact email.

How can I make sure that email address is unique? Is there a setting somewhere that I missed. Right now it does allow duplicates and if the contact record exists the application adds the new membership to that contact.

Any pointers appreciated ;D

use

hook_civicrm_validate on the membership form and ensure that the email is unqiue
