Using HTML snippet for GID=13 returns error that Profile GID=4 disabled

Hi  - hoping someone can point out the error of my ways.
Profile 13 is going to be used for a simple sign up block in Drupal so grab the HTML snippet and add to block - filling in and submitting takes me to

/civicrm/profile/create&gid=13&reset=1

But I get a non-recoverable error relating to a different GID number

UPDATE comparing to the create url http://gg.dev.fuzion.co.nz/civicrm/profile/create?gid=13&reset=1 i see that the HTML snippet is giving me an '&' rather than a '?'

Editing the block seems to fix this. So not sure if I am doing something wrong and making it worse, but it seems to work with my edit.

So the code in the html snippet was this

I'm seeing the same thing with version 3.4.1. In process of upgrading to 3.4.2 - has it been fixed in this. Also I'm seeing that when I submit the form although the contact is created, it is not being added to the group specified in the profile settings.

Having similar issues with CiviEvent after playing around with OG and modifying permissions - only happens when not logged in (public).  Any help would be greatly appreciated.
