Pending transactions converts previous pending membership to expired

I have a member who had a pending Lifetime membership.   This week he tried to renew again at a different level, but the transaction for some reason did not complete leaving a new pending contribution.  However, the previous pending Lifetime membership now has status expired! there is a pending contribution with another  membership level, but no pending memberships.

multiple pending transactions should not be converted to expired memberships ...
