Pathing and WSOD errors

Drupal 6, 4.1 Beta 3

New install, working ok but with 2 exceptions:

1) Intermittent "Oops! - The CiviCRM settings file (civicrm.settings.php) was not found in the expected location (sites/default/civicrm.settings.php)."

All settings have been checked several times, install went according to the book no problem. Have had tech help checking the apache rights and other permissions and all are fine.

He's tried to find the error (and he's new to the system) and seems to think that there is a call that is not using/picking up the the correct value for the location?

Anyone got any clues how to help.

2) Drupal to user synch does a WSOD - although manually input new records seem to synch fine.

Any help or ideas gratefully appreciated as about 3 man days gone into trying to tie these down so far...

The 2nd item has been fixed here and will be part of next release:

no idea about the intermittent error u r seeing. seems  a bit wierd

Just to confirm that the proposed patch above does cure the first problem - great!! but I am still getting the other error message on most pages once logged in as admin.
