Contact preferences for deceased contacts

We recently upgraded a site to 4.1.x and discovered that contacts set as deceased do not have all the contact preferences as false. When you attempt to do a mailing CiviCRM will not send email to the deceased contacts so that is working as it should. However in the contact record itself the contact preferences are not changed when the contact is set to is_deceased, and we are fairly certain that it did that in previous versions.

In our case we are using mailchimp, not civimail, and our users export various sets of contacts based on groups depending on the purpose of the mailing. So our issue is not with mailing but with exporting from a search. We have the situation now where contacts set as deceased are in our results to be mailed. I understand that we could refine the search parameters before exporting but that would involve training and risk user error.

Was there a decision to change the behaviour of the communication preferences for deceased or is this a new bug in 4.x? I have searched the forums and issue queue but didn't find anything about this. If this is a bug I can file a report. Is it a design decision? In that case I'd like to know the rational.

I'm pretty sure we never modified the contact preferences behavior for deceased contacts :(. If you are very certain of this, can you please check an older codebase and track it down

The mailing query and other batch queries explicitly exclude contacts who are deceased.
