Renewal up-sell changes membership status

Here is our membership structure (six membership types to allow for 2 x multiple years):

Individual 1yr, 2yr, 3yr
Family 1yr, 2yr, 3yr

A existing member is current with 3yr Individual membership but then pays for 1yr Family membership.  One year is added to his existing membership and the status is changed from Individual to Family.  Member now enjoys Family membership at the Individual rate (not good).

Is this expected behavior?  If so, has anyone worked out a solution to prevent this scenario?
