Javascript js requirements on contribution pags

a question about JS and contribution pages

if a user has JS off in their browser - and hits a form with credit card OR pay later, and selects credit card, they
- get pushed to 'confirm/thank you page'
- get sent a Pay Later Invoice
- end up with a transaction in DB with payment_instrument_id set to NULL

we are trying a simple warning msg with a 'JS is required for this page to work' box - any other thoughts/comments?

should this be patched in core?
