contrib dir with Rest API

I am using a brand new 4.3.5 (drupal6), which is placed in
sites/all/modules/contrib/civicrm

When trying to use the REST API I found a very similar problem as
http://issues.civicrm.org/jira/browse/CRM-9733?page=com.atlassian.jirafisheyeplugin:fisheye-issuepanel

But this issue should have been solved in 4.2?

If I download a civicrm 4.3.5 for drupal6 then this solution is not found in the code.
