Price set field required after its end date

I have a field in a price set for registration called "early bird" which gives a discount if submitted before April 15.  That field has a start and end date.  I had it configured as "required" so that people could not uncheck it and would always get the discount.

After expiration though, the field is not displayed, but the form validation says "early bird is required".  Shouldn't the fields which have passed their expiration or display date not be counted in the form validation for required?
