Civi Merge rules and V3 API

The organisation I am with is currently upgrading our CiviCRM and some custom code that hangs off of the CiviCRM and drupal installs  we have and came across and just wanted to see if it was an actual bug or not. Am I right in thinking there are no more "Strict" Dedupe rules in Civi 4.4 and as such would that mean that line 332 here https://github.com/civicrm/civicrm-core/blob/master/api/v3/Contact.php needs to be updated to be unsupervised? if so happy to contribute the patch but just wanted to check
