Does the AGPL prevent a developer from creating a propriety CiviCRM extension?

Since in AGPL a network user constitutes a distribution of the application, when someone uses CiviCRM on your website, you are distributing the application and therefor must provide the source code to your users.

If I create a proprietary extension, that modifies the way CiviCRM works (using hooks), is that extension violating the AGPL by being distributed to network users and the source code is not being made available to those users?

Basically, do I have to license an extension under AGPL? or is there an alternative licenses that can be used that prevents having to provide the source code to the users? is using an alternative licenses for the extension violate CiviCRM's AGPL?

I think you're asking the wrong people. You need to ask a lawyer and not just any lawyer, you need to talk to an IP lawyer who knows OSS licensing.
