I have set up a profile with email field. Setting: individual - email - primary
The 'Update contact on a duplicate match' setting of the profile is not ticked.
A Duplicate Matching Rule is set to: Email
When a new individual contact is created using the profile the email address is stored as Home email of the Primary Location.
When a second individual contact is created using this profile with the same email address NO message for duplicate contact is displayed and the old record is overwritten.

When I change the email field in the profile to 'individual - email - home' the message is displayed and records not overwritten (as expected).

I must be missing a settings since I can not repoduce this situation in a fresh 1.9.13019 installation.
What am I missing? I would prefer not to use the 'individual - email - home' workaround.

Its bit difficult for us to support CiviCRM v1.9. Can you replicate this on demo. If you are able to replicate this file an issue in jira.
