Small Bug with "Send an Email" Action

I created two new contacts on the demo site. One with name "Hershel Email" with an email and one called "Hershel NO Email" with no email. No data beyond first name, last name and email was entered for either. I run a search on the name "hershel" and both come up. I then select both and choose "Send an Email" and press Go. I then see:

Email will NOT be sent to 1 contact - communication preferences specify DO NOT EMAIL.

It is correct that one contact can't receive email, but that is not the correct reason. The correct reason is because he has no email.

I think this message is incorrect and if it IS somehow by design, then it's I think it's misleading.
