Default Footer or Header is not Default

Although there is a "default" checkbox when a new header or footer is added(and code to sort by isdefault), it doesn't seem like it makes any difference, it still has to be selected when a mailing is being created, whats up with that?
 How can I fix it?

this seems like a bug. Can you reproduce this on our demo server and if so file an issue and we'll fix for 2.3

If you want to fix the code, the relevant file is: CRM/Mailing/Form/Settings.php, function setDefaultValues, lines 58-76
